In a unanimous decision delivered by a panel of five Justices, the apex court dismissed an appeal filed by the All Progressives Congress (APC) and its candidate, Uche Nnaji, challenging Governor Mbah's win in the gubernatorial election.
Justice Tijani Abubakar, who prepared the lead judgment, determined that Nnaji and his party submitted an invalid brief of argument. The Supreme Court found that the appellants failed to provide any compelling reason why the flawed submission should be considered as grounds for invalidating Governor Mbah's election victory.
The Supreme Court, in light of the legally defective brief of argument, concluded that it impacted the overall appeal's credibility. As a result, the case brought by the appellants was dismissed on the grounds of incompetence.
It's worth noting that the Court of Appeal in Enugu had previously dismissed Nnaji's case against Governor Mbah on July 18. The appellate court ruled that the appeal, marked: CA/E/E/EP/GOV/EN/01/2023, lacked merit and upheld the decision of the Enugu State Governorship Election Petitions Tribunal, which affirmed Governor Mbah's election victory.
Furthermore, the appellate court imposed a cost of N250,000 each on Nnaji and the APC.
In the gubernatorial election in Enugu state, the Independent National Electoral Commission (INEC) declared that Governor Mbah secured a total of 160,895 votes, defeating Chijioke Edeoga of the Labour Party (LP), who received 157,552 votes. Frank Nweke Jnr. of the All Progressives Grand Alliance (APGA) came in third with 17,983 votes, while Nnaji placed fourth with 14,575 votes.
